PRELIMINARY ARTICLE
In an effort to better meet the expectations of its customers, Slow Control SAS (hereinafter referred to as "Slow Control") wanted to set up, in parallel with the points of sale where its products are also sold, a remote sales network by electronic means (Internet).
The system thus put in place, which presupposes an active approach on the part of the customer, fully complies with the requirements for distance selling and, in particular, with Articles L. 111-1, L.112-1 and L. 221-1 et seq. of the French Consumer Code.
The use of the distance selling process described in these General Conditions of Sale is reserved for consumers only, as defined by law and jurisprudence, acting exclusively on their own account and domiciled in one of the territories listed above.
Article 1: Scope of application
These General Terms and Conditions of Sale apply to all sales of Slow Control packages entered into via the merchant site accessible on the website www.slowcontrol.com for delivery within the territories listed above only.
As a result, the customer declares that he has read these General Conditions of Sale before placing his order. The validation of his order therefore constitutes acceptance without restriction or reservation of these General Conditions of Sale.

Article 3: Conditions for ordering articles
To place an order on the Site, the customer must be of full age, have his usual residence in a country belonging to the territories listed above, have the legal capacity and be holder of a bank card as defined in Article 5 below. Orders will be accepted within the limit of available stocks.
To this end, the customer is informed at the time of the order, either by the Customer Relations Department, or on the information page of the Site describing each of the articles:
the availability of the item; or if the item is temporarily unavailable, the possibility of ordering it for subsequent delivery within the time specified on that occasion.
If, despite the vigilance of Slow Control, the ordered items are no longer available, Slow Control will inform the customer by e-mail as soon as possible. In case of debit or collection for the order of an unavailable item, Slow Control undertakes to refund the Customer within fifteen (15) days.
The Customer undertakes to ensure that all information communicated to Slow Control to the Customer Relations Department or on the Site as part of the order complies with these Terms and Conditions of Sale, is complete, accurate and up-to-date. Otherwise, Slow Control reserves: (i) the right to cancel the order and the payment altogether or, (ii) to make them subject to the communication, by the customer, of any proof of the information and addresses communicated, to ensure their existence and accuracy.
Article 4: Prices
Customs fees, if any, will always be borne by the customer.
The prices presented on the website or online shop are final. They are guaranteed subject to typography or printing errors.
Prices may be changed at any time, without prior notice and in particular in the event of a change in tax or economic data. Items will be billed based on the rates in effect at the time of order registration.
Article 5: Conditions of payment
In case of payment by credit card, the customer’s credit card is charged at the time of preparation of the order.
To this end, the customer guarantees to Slow Control, when ordering via the Internet, that he is the holder of the bank card and that the name appearing on this bank card to be debited is his and then communicates, in a secure environment on the Internet, the number and expiry date on the front of his bank card and the visual cryptogram numbers on the back (or front) of his bank card.
In the event that, for whatever reason (opposition, refusal of the issuing centre, etc.), the debit of the sums due by the customer is impossible, the Internet purchase process is cancelled.
In case of a successful transaction, an invoice will be sent to the e-mail address indicated at the time of the order. It shall be drawn up in accordance with the tariff in force on the day on which the order is placed. Slow Control is not responsible for any input errors.
Article 6: Delivery
In accordance with the provisions of the French Consumer Code, the delivery of the ordered items will take place within the deadlines communicated by Slow Control and, if not specified, in any event not later than thirty (30) days from the date of the order, subject to full payment of the price.
Any delays communicated by Slow Control will only be indicative. If, during delivery, the exterior appearance of the package is not perfect, the customer will open it in the presence of the carrier to check the condition of the item. In case of damage to the article, the customer will immediately inform the Customer Relations Department by sending an email to the following address: contact@slowcontrol.com.
Any request can be made in English, French, Spanish, German or Italian.
Article 7: Cancellation of an unprocessed order
There is a four (4) hour delay between the validation of an order on our website and the transmission of relevant information to the carrier. Once this information is transmitted and processed, the order cannot be cancelled. Thus, if, after placing an order on our site, the customer wishes to cancel it and get a refund immediately, he must inform us within the aforementioned period, by sending an email to the following address: contact@slowcontrol.com. Any request for cancellation after the deadline will be inadmissible and any return costs will be borne by the customer.
Article 8 : Right of withdrawal
Slow Control intends that those of its customers who are not satisfied with the ordered items can exercise the right of withdrawal provided by article L. 221-18 of the Consumer Code under the best conditions.
In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for orders relating to:
- the supply of goods made to consumer specifications or clearly customized
- the supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection.
The customer must, within fourteen (14) days of delivery, notify the Slow Control Customer Service in advance of their request.
Return Procedure
• Take pictures of the product before shipping and especially the one by opening the battery-operated hatch with the photo of the electronic card number and its QR code to properly identify the electronic card.

• We will diagnose the electronic card to see if it has been used (chip memory) - As per Article 8 / L221-28 / GTC (see above).
• If it has not been used for meals, we will then refund your order within 14 days.
In any case, the customer must return the items delivered in their original packaging, complete (batteries, instructions, etc.) and indicate the order number and the name under which the order was made. Returned items that are incomplete, damaged, damaged, deteriorated, soiled or in any other condition that would reasonably suggest that they have been used or worn will not be refunded or exchanged and will be returned to him.
The direct costs of returning the item will then be borne by the customer, unless Slow Control has delivered a product that turns out to be defective or different from the ordered item. It will be up to the customer to provide proof of this return, which presupposes that the items must be returned by registered mail, or by any other means giving certain date.
The refund of the amounts paid for the returned item(s) will be made, depending on the method of payment of the items, by credit to the customer’s bank account corresponding to the bank card used for the payment or by transfer to the customer’s bank account. Pursuant to Article L.221-24 of the French Consumer Code, additional charges paid by the customer and related to the choice of a specific delivery method will not be refunded.
Beyond the period of 14 (fourteen) days from delivery, the goods will not be taken back or refunded.
The provisions of this article (including the extension of the right of withdrawal until 14 (fourteen) days) apply only to purchases made at www.slowcontrol.com. Any other customer who has purchased his Slow Control package through a commercial partner (a third-party website, a physical store, etc.) will be subject to the General Conditions of Sale of said merchant. However, this clause shall not prejudice the customer’s ability to exercise his rights under Articles 217-4 et seq. of the Consumer Code as regards the legal guarantee of conformity, listed in article 11 below.
Article 9: Obligation of the Parties
Slow Control, in the case of acceptance of an order, undertakes to sell and deliver to the Customer the products ordered by the latter according to the terms specified above.
Slow Control undertakes to verify that the products comply with the European regulations in force.
The Customer undertakes to provide Slow Control with an address where delivery can be made. The filling in of personal information (name, address, telephone, e-mail address, etc.) collected for the purpose of concluding the sales contract is mandatory. This information is essential for the processing and routing of orders and the preparation of invoices. Failure to provide this information will result in the order not being validated. In the event of an error in the provision of this information, Slow Control shall not be held liable for the inability to deliver the product. In this case, the customer remains responsible for the payment.
In case of supply of an incomplete address resulting in the impossibility of delivery by the transport provider, the Customer will have to pay the delivery costs corresponding to the redirection of his order.
Article 10: Liability
While Slow Control takes great care and accuracy in putting information on-line at www.slowcontrol.com, it cannot be held responsible for non-substantive errors that may occur. Similarly, although the photographs and other reproductions of the articles accurately represent them on the site -and this, within the limits of the technique and in compliance with the best standards of the market-, they may nevertheless present errors not-substantial, which the client acknowledges and accepts.
Furthermore, Slow Control cannot be held responsible for:
– Interruptions or delays recorded by the Customer Relations Department or on the Site due to the execution of maintenance work, technical failures, force majeure, by third parties or any circumstances whatsoever, independently of his will; and
– The impossibility of the customer to contact the Customer Relations Department and/or to access the Site momentarily, due to facts beyond his control, such as: cases of computer failure, the internet network, failure of the equipment for receiving the said internet network, etc.
Article 11: Legal guarantee of conformity
According to Article L217-7 of the French Consumer Code, any Slow Control package benefits from the legal guarantee of conformity. Any return of the product under the aforementioned guarantee must be subject to prior agreement by Slow Control. To this end, the Customer will contact the Slow Control service, by sending an email to contact@slowcontrol.com.
Article 12: Personal data
The Customer undertakes to ensure that all information communicated to Slow Control to the Customer Relations Department or on the Site as part of the order complies with these Terms and Conditions of Sale, is complete, accurate and up-to-date.
Otherwise, Slow Control reserves: (i) the right to cancel the order and the payment altogether or, (ii) to make them subject to the communication, by the customer, of any proof of the information and addresses communicated, to ensure their existence and accuracy.
It is recalled that when ordering Slow Control collects the following personal data: identity, email address, telephone number, address of usual residence of the customer, delivery address and means of payment. This data is necessary for the processing of the order and can be communicated only to the contractual partners of Slow Control involved in the execution of the order (in particular, to intermediaries for the payment of orders such as banking establishments). In accordance with the Data Protection and Freedom Act of 6 January 1978, the Customer has the right to access, modify, rectify and delete personal data concerning him. If the Customer wishes to exercise this right, it is enough for him to write to Slow Control – 59 rue des petits champs – 75001 Paris, indicating his last name, given names, address and the details of the request.
Slow Control reserves the right to collect data about the Customer through the use of cookies in order to improve the personalized service intended for the Internet user.
Article 13: Validity of the general conditions of sale
The invalidity or unenforceability of any of the provisions of these General Conditions of Sale or the Special Conditions shall not affect the application or validity of the other provisions of the General Conditions of Sale. This clause will then be replaced by the closest possible provision.
Article 14: Force majeure
Slow Control’s performance of all or part of its obligations will be suspended in the event of the occurrence of a fortuitous event or force majeure within the meaning of Article 1218 of the Civil Code which would prevent or delay its performance. Slow Control will inform the customer of such a fortuitous event or force majeure within seven (7) days of its occurrence. If this suspension of the performance of the Slow Control obligations continues beyond a period of fifteen (15) the customer will then have the possibility to cancel the order in progress and it will then be refunded by Slow Control as soon as possible by credit on the customer’s bank account.
Article 15: Applicable Law and Court of Competent Jurisdiction
These general conditions of sale are governed exclusively by French law.
The commercial courts of Paris shall have sole jurisdiction in the event of any dispute concerning them.
